Spain Residence Permit Changes 2026

In September 2026, important changes to Spain’s immigration rules came into effect. The Spanish Supreme Court annulled several provisions affecting residence permits for family members of Spanish citizens, dependent parents, minors and certain immigration application procedures.

The rulings were officially published on 22 September 2026. Here is what has changed and how these decisions may affect foreign nationals applying for residence permits in Spain.

Residence Permits for Family Members of Spanish Citizens

One of the most significant changes concerns residence permits for family members of Spanish citizens.

Previously, certain provisions required specific family relationships to be legally established under Spanish law.

The Supreme Court annulled this restriction.

As a result, in the relevant cases, an application cannot be refused solely because the family relationship was legally established under the laws of another country.

However, applicants must still provide appropriate documentation proving their family relationship. Depending on the circumstances, certified translations, apostilles or legalisation of foreign documents may be required.

What this means: Foreign nationals whose family relationships were legally established outside Spain should review their eligibility for a residence permit under the updated rules.

Residence Permits for Parents: Proving Financial Dependency

Another important change concerns parents and other dependent relatives in the ascending line who apply for residence permits based on family relationships.

Previously, one provision required financial dependency to exist in the relative’s country of origin or previous residence.

The Supreme Court annulled this restriction insofar as it prevented applicants from demonstrating financial dependency that arose or continued after the relative had arrived in Spain.

Therefore, the fact that a parent is already living in Spain should not automatically prevent them from proving financial dependency.

However, applicants must still demonstrate genuine dependency and meet the other applicable residence permit requirements.

What this means: Families whose dependent parents are already in Spain may wish to reassess their eligibility for residence under the revised rules.

A Criminal Record Does Not Always Mean Automatic Refusal

The Supreme Court also annulled provisions that allowed automatic refusals based on criminal records in certain residence permit procedures for family members of Spanish citizens.

Where the relevant safeguards under European Union law apply, immigration authorities must assess the individual circumstances of each case.

This does not mean that criminal records are no longer relevant or that a residence permit must automatically be granted.

However, a refusal should not be based solely on the existence of a criminal record without the required individual assessment.

Changes Affecting Minors

The rulings also affect residence permit procedures for children.

The Supreme Court annulled certain restrictions relating to the family circumstances of minors.

In addition, a temporary and justified departure from Spain after a child’s birth should not automatically prevent the application of the relevant residence permit procedure.

The authorities must consider whether the child has maintained their actual habitual residence in Spain.

This may be particularly relevant for foreign families whose children were born in Spain but temporarily travelled abroad.

Changes to Electronic Immigration Applications

The Supreme Court also annulled a provision requiring mandatory electronic communication in certain immigration procedures.

However, this ruling does not eliminate online immigration applications.

Public authorities may still impose electronic filing requirements where there is an appropriate legal basis and the relevant conditions are met.

Applicants should therefore check the available submission methods for their specific immigration procedure. For procedures that require one, see our Spanish digital certificate service.

What If Your Residence Permit Application Was Previously Refused?

If your residence permit application was refused on grounds affected by the Supreme Court rulings, it may be worth reviewing whether the decision can be challenged.

Important factors include the date of the refusal, the legal grounds cited, applicable appeal deadlines and the individual circumstances of the case.

The annulment of certain regulatory provisions does not mean that all previous refusals will be automatically reconsidered.

Nevertheless, the rulings may provide important legal grounds for challenging certain immigration decisions.
